Prudential Group Employee Privacy Notice
Prudential Services Limited ("Prudential") has prepared this Employee Privacy Notice ("Notice") to be provided to its and its subsidiaries’ or affiliates’ employees. We need to process your personal data when we consider your job application or employ you. However, the purpose of this Notice is to give you information about how Prudential collects, processes, stores and otherwise uses information about you, and your rights in relation to that information.
Prudential needs to process your personal data in order to consider your job application, enter into our contract of employment with you and to continue to perform crucial aspects of your contract of employment such as paying you and providing you with benefits. There are also statutory requirements and other contractual requirements we have to comply with in relation to your employment as well as business and operational needs we have to meet. If we are not able to carry out the processing activities we describe in this Privacy Notice we may not be able to process your job application, comply with your contract of employment, and in very exceptional cases, may not be able to continue your employment. Of course, we hope it would never come to that, and this is simply information we are obliged to provide to you as part of this Notice.
In certain limited circumstances we may need to ask for your specific consent to process your personal data in a particular way. However, in most cases we will process it for the reasons set out in this Notice and it won't be appropriate or necessary for you to provide consent.
When we say "Prudential", "we" or "us" in this document, we mean your employing company. This is the entity with which you submit your job application or have an employment contract. In addition, you will see a number of references to the "Prudential Group", which includes all other Prudential entities globally. Details of these can be requested by contacting us as stated below (Who can I contact about this?). As with many other Prudential policies, this document is not part of your contract of employment, and we may update it from time to time, for example if we implement new systems or processes that involve the use of personal data.
Prudential may make changes to this Privacy Notice from time to time by updating it on MyHR and website (https://www.prudential.co.th/corp/prudential-th/en/privacy-notice-staff/). We encourage you to check it from time to time on MyHR and website (https://www.prudential.co.th/corp/prudential-th/en/privacy-notice-staff/), as the version of this Privacy Notice which is displayed on MyHR and website (https://www.prudential.co.th/corp/prudential-th/en/privacy-notice-staff/) takes precedence over all previous versions. We will notify you of any changes to this Privacy Notice and obtain your consent, to the extent applicable and if required.
What categories of personal data does Prudential collect about me and why does Prudential use it?
"Personal Data" means any information relating to you. Prudential will collect, process and use the following categories and types of personal data about you, also defined as “Employee Data”:

identification data, such as your title, name (including surname, maiden name, previous name), signature, employee number, your image / photo, voice and video recording, business email address, business address, business landline, citizenship, nationality, residency, ;

government issued identification: such as national identifier, passport / visa data, drivers' licence information, national insurance number, household registration, tax identification and documents, marriage certificate, vehicle registration, vehicle plate number, other government-issued identification (e.g. green card identification), work permit, and certificate of name change;

personal information, such as your date and country and place of birth, age, emergency contact details and gender;
-
contact details, such as your home address/registered address in government records, contact address, working address, postal code, contact detail history, telephone number and personal email address;

information about your job, such as your position, job title, employee type, grade, time type (full or part time), working time information, work location, division, department, manager (name & employee number), start and end date, contract status, job history (including role history, title history, effective dates and past pay groups), education history, license information (such as broker / agent license) and qualifications, worker history (including records of changes in HR databases) and reason for leaving;

educational background: such as institutions, duration, transcript, major activities while studying, scholarship/awards obtained, and achievements;

pre-employment screening data, such as information obtained through application form (g. position you applied for, your position applied for, salary required, family particulars, language proficiency, typing skills, computer skills, other special skills/abilities, and commencing dates, previous workplace and work experience), credit checks, references, resumes;

information about your salary and benefits, such as your basic salary and bonus, salary increases (amounts and percentages), allowances, benefits (including information about you and your dependants that we provide to the benefit providers), disbursement and payment information, corporate insurance coverage information, pension plans, provident fund information, tax code, your bank account details and payment dates, accrued salary information, employee pay group, and information relating to your pension, loan and support information;

Spouse/partner and dependents’ information, such as your spouse and dependents’ full names, dates of birth, and contact details.

information about your share plans, such as number of shares held, details of all restricted share plans or any other entitlement to shares awarded, cancelled, exercised, vested, unvested or outstanding in your favour;

Business travel information, such as business travel itinerary, booking information and corporate expenses incurred;

Details of declarations such as any secondary employment, conflict of interest declarations (may include your immediate family members’ information) or gift declarations, details in the self-declaration form .

Workplace, Device, Usage, and Content data, such as systems / buildings access monitoring information, such as CCTV images, building card access, internet, work email and telephone usage data, and user generated content on Prudential systems / platforms;

performance, development and disciplinary information, such as development, engagement survey, training or e-learning information, performance reviews and ratings, information about complaint, misconduct or disciplinary allegations, the disciplinary allegation process, investigation and any disciplinary warnings, details of grievances and any outcome;

absence information, such as dates of leave of absence, holiday, maternity leave, paternity leave, adoption leave, shared parental leave, compassionate leave, confirmation of a birth of a child, study leave, family care leave, medical leave; and

organisational data including employee number for IT systems, company details, cost centre allocations, and organisations.

corporate equipment / network usage including information required to access company systems and applications such electronic content and metadata produced by you using our systems, details such as your mobile phone location data, IP address and MAC address, browser and device information, log-in credentials, online usage, logs, and information collected through other technologies

We collect and use this Employee Data for a variety of reasons linked to your recruitment and employment. To help clarify these we have set out below a list of reasons why we collect and use this data (the "Processing Purposes") along with examples of some of the Employee Data used for each of the Processing Purposes:

Assess the applicant's suitability for the position being applied for or other positions the Company may have available; also including background checking and validating, and on-boarding processes for those positions;

administering and providing compensation, including payroll, expenses, bonus, share awards, and other applicable incentives which involves the processing of identification data, contact details, information about your job, reward package, performance and disciplinary information; absence information and organisational data; also including managing your pension benefits during and post-employment;
-
administering and providing applicable benefits and other work-related allowances, including reporting of benefit entitlements and take-up of benefits which involves the processing of identification data, contact details, information about your job, reward package, performance and disciplinary information; staff administration, health and wellness services provided by Pulse App; absence information and organisational data;

administering our workforce and managing the employment relationship including managing work activities, tracking working hours, tracking internet, email and telephone usage, providing performance evaluations and promotions, producing and maintaining organisational charts, Business Unit and intra Business Unit resourcing and team management, managing and monitoring business travel, carrying out workforce analysis, conducting workforce surveys, conducting talent management and career development, holiday management / approvals, providing references, and administering mandatory training which involves the processing of identification data, contact details, information about your job, reward package, performance and disciplinary information; absence information; organisational data; and recruitment for other roles both during and after the end of your employment; also including managing your employment, on-boarding, keeping your information on record, managing business continuity and reporting, succession plan (Emergency recover), assigning you to work overseas, and performing functions related to our businesses operation;

carrying out activities relating to executive level officer, including selecting and promoting you as an executive-level officer, maintaining corporate records and databases, facilitating and assist you to perform your duties and responsibilities, monitoring your performance and responsibilities, and arranging meetings, training and seminars;

providing IT systems and support to enable you and others to perform their work, to enable our business to operate, and to enable us to identify and resolve issues in our IT systems, and to keep our systems secure which involves processing almost all categories of Employee Data;

complying with applicable laws, regulatory and employment-related requirements along with the administration of those requirements, such as income tax, national insurance deductions, health and safety at office and during business travel, employment and immigration laws, and laws relating to sanctions, which involves the processing of identification data, contact details, information about your job, reward package, performance and disciplinary information; absence information and organisational data;

detecting and preventing fraud, including checking your provided data against databases, conducting due diligence, and/or any other form of background checks or screening or risk identification on you (including checking public/private information or government law enforcement agency), carrying out other security risk checks, to prevent fraud, money laundering, financing of terrorism, and crime;

carrying out corporate transactions, including transferring your Personal Data as part of the transaction in the event of merger such as, in sale, transfer, merger, reorganization or similar event;

handling disputes, solving disputes, enforcing our contracts, establishing, exercising or defending of legal claims and legal rights;

monitoring and ensuring compliance with applicable policies and procedures and laws, including conducting internal investigations, which involves the processing of identification data, contact details, information about your job, reward package, performance and disciplinary information; absence information and organisational data;

communicating with you, other Prudential employees and third parties (such as existing or potential business partners, suppliers, customers, end-customers or government officials) which involves the processing of identification data, contact details, information about your job and organisational data;

protecting our legitimate interests, including protecting your and others' health and safety, allowing and restrict access to our premises, office equipment and other property.

communicating with your designated contacts in the case of an emergency which involves the processing of contact details, information about your job and organisational data;

responding to and complying with requests and legal demands from regulators or other authorities in or outside of your home country which involves the processing of identification data, contact details, information about your job, reward package, performance and disciplinary information; absence information and organisational data;

In addition to the collection, processing and use of the Employee Data, Prudential collects, processes and uses the following special categories of personal information about you which we describe as "Sensitive Employee Data":

health and medical data, such as medical record, medical examination, diagnosis, injury, surgery, medical consultation and advice, history of illness and serious accident, physical and mental conditions, medical check-up report, the number of sick days and the information contained in a doctor's certificate / occupational health report for purposes of salary payment, workforce planning and analysis, and compliance with legal obligations; information on work-related accidents for purposes of insurance compensation, work safety and compliance with legal obligations (such as reporting obligations); information on disability for purposes of accommodating the work place and compliance with legal obligations; information on maternity leave / adoption leave / shared parental leave for purposes of workforce planning and compliance with legal obligations;

criminal records data, in the event that Prudential has conducted pre-employment or annual screening checks and received the results of criminal records background checks in relation to you where relevant and appropriate to your role; for the purpose of checking and considering the qualification and suitability in accordance with the relevant local laws relating to insurance business for which the will conduct the check with the competent government authorities in relation to such criminal records;

race or ethnicity data such as information contained in your passport or other citizenship and right to work documentation, and information which you have voluntarily provided to Prudential for the purposes of our equal opportunities and diversity monitoring and initiatives;

biometric data, such as facial recognition template; for the purpose of carrying out the identification and authentication processes in case of providing employee administration or employee benefit services via electronic channels, such as application and website.

sexual orientation data such as marital status and information contained in your marriage / civil partnership certificate for the purpose of administering name changes, and, where this has been provided voluntarily to Prudential for the purposes of our equal opportunities and diversity monitoring and initiatives.
Employees in Thailand

Health and medical data (for employee who is required to register as an insurance agent and for the direct sales or telemarketing sales job duty):
For the purpose of declaration on congenital disease (including the diseases that require the use of addictive drug for treatment, drug use, history of substance abuse and narcotic rehabilitation) required by the insurance regulator for life insurance agent registration purpose ; for checking the qualification, suitability, and prohibited characteristics of being a life insurance agent;

political status for the purpose of background screening or checks (such as politically exposed person checks) or compliance of regulatory requirement; and
-
religion and blood type as declared in the government-issued document; for the purpose of carrying out the identification and authentication processes and disclosing to relevant government authorities when required for pre-employment or annual screening checks.
Employees in Philippines:
In addition to the information shared above, the following data is considered as Sensitive Employee data:

Why does Prudential need to collect, process and use my Employee Data and Sensitive Employee Data?
Both Employee Data and Sensitive Employee Data are needed by Prudential to carry out a variety of activities that are linked to your employment and Prudential's compliance with its obligations as a result of employing you and as a business.
We are required to explain to you the legal bases for our collecting, processing and use of your Employee Data and Sensitive Employee Data. The legal basis to be relied on will be subject to the local privacy law. We have a number of these listed below:
For Employee Data, our legal bases are listed below:

performance of the contract of employment with you; compliance with legal obligations, in particular in the area of labour and employment law, social security and protection law, data protection law, tax law, and corporate compliance laws;

the legitimate interests of Prudential, Prudential affiliates or other third parties (such as existing or potential business partners, suppliers, customers, end-customers or governmental bodies or courts);
-
your consent, where that is appropriate, meets the requirements of data protection law and has been separately obtained;
-
protection of vital interests of you or of another individual;
-
performance of a task carried out in the public interest or in the exercise of official authority vested in Prudential.
For Sensitive Employee Data, our legal bases are (subject to compliance with local legal requirements):

explicit consent as required by local data protection law;

to carry out the obligations and to exercise the specific rights of Prudential or you in the field of employment and social security and social protection law as permitted by local data protection law and / or a collective agreement;

to protect the vital interests of you or of another individual where you are physically or legally incapable of giving consent;

public data as made public manifestly by you;

data disclosed to public with your explicit consent.

to establish, comply with, exercise or defend a legal claim or whenever courts are acting in their judicial capacity;

for substantial public interest as permitted by local data protection law;

for assessment of the working capacity of the employee as permitted by local data protection law; and

necessary for compliance with a legal obligation/law to achieve purpose in respect to employment protection, social security, social welfare of the entitled person by law, social protection, substantial public interest, or assessment of the working capacity of the employee in which the collection of personal data is necessary for exercising the rights or carrying out the obligations as permitted by local data protection law;
We appreciate that there is a lot of information there, and we want to be as clear with you as possible over what this means. Where we talk about legitimate interests of Prudential or third parties, this can include:

Implementation and operation of a Group-wide organisational structure and Group-wide information sharing;

When relying on the legitimate interests basis for processing your personal data, we will balance the legitimate interest pursued by us and any relevant third party with your interest and fundamental rights and freedoms in relation to the protection of your personal data to ensure it is appropriate for us to rely on legitimate interests and to identify any additional steps we need to take to achieve the right balance.
Where we get your personal information?
We’ll collect personal information from the following general sources:

from you directly;

information generated about you during the course of your application for employment or during the course of your employment with us;

from a broker or other intermediary (for example, employment agencies and consultancies) who we work with;

Prudential Group companies;
-
Cookies, location services, IP addresses when you visit our website or mobile app;

CCTV footage at office premises;
-
Questionnaire and contact details when you attend surveys or when you update contact us form on our website;

from other sources such as previous employers, Fraud Prevention Agencies, Credit Reference Agencies, other lenders, publicly available directories and information (for example, telephone directory, social media, internet, news articles), debt recovery and/or tracing agents, other organisations to assist in prevention and detection of crime, police and law enforcement agencies.
Who might Prudential share your personal information with?
As you know, we are part of the global Prudential Group, and several entities in this Group are involved in the Processing Purposes. To ensure that the Processing Purposes can be completed, your information may be shared with any of the entities within the Prudential network. Where we do share data in this way, it is our policy to limit the categories of individual who have access to that personal information.
Prudential may transfer personal data to third parties, including to entities within and outside the Prudential Group located in any jurisdictions where Prudential Group entities or our data processor are located, for the Processing Purposes as follows:

Within the Prudential Group. As Prudential Services Limited is part of a wider Group headquartered in the UK with offices located across the globe, Prudential may transfer Employee Data and Sensitive Employee Data to, or otherwise allow access to such data by other entities within the Prudential Group, which may use, transfer, and process the data for the following purposes: to maintain and improve effective administration of the workforce; to communicate information about the Prudential Group; to maintain a corporate directory; to maintain IT systems; to monitor and assure compliance with applicable policies and procedures, and applicable laws; and to respond to requests and legal demands from regulators and other authorities.

Pulse Ecosystems Pte Ltd, a Singapore company (“PulseCo”). As necessary for providing the access to services, functionalities, features and information of Pulse App, the employment information (including but not limited to employee’s name, title, business contact, work location, department); employee ID number, date of birth, questionnaires, devices and wearables may be transferred to PulseCo and its operator.

Communication with third parties. As necessary in connection with business operations, work contact details and communication contact details may be transferred to existing or potential business partners, suppliers, customers, end-customers or government officials and other third parties.

Regulators, authorities, and other third parties. As necessary for the Processing Purposes described above, personal information may be transferred to governmental, regulatory or other public authorities in local and overseas as applicable include, but not limit to the insurance commission, business registration department, revenue department, department of labor, department of skill development, anti-money laundering office, securities and exchange commission, legal execution department, national police bureau, and/or national anti - corruption commission, courts, and other authorities (e.g. tax and law enforcement authorities), independent external advisors (e.g. auditors), Directors within the Prudential Group, insurance providers, pensions and benefits providers, internal compliance and investigation teams (including external advisors appointed to conduct internal investigations), and third-party participants in legal procedures or other third party if we believe to be necessary or appropriate to comply with our legal obligations, defend legal rights or positions of us or otherwise the rights of any third party or individuals’ personal safety, and allow us to pursue available remedies or limit our damages.

Acquiring entities. If the Prudential business for which you work may be sold or transferred in whole or in part (or such a sale or transfer is being contemplated), your personal data may be transferred to the new employer or potential new employer as part of the transfer itself or as part of an initial review for such transfer (i.e. due diligence), subject to any rights provided by applicable law, including jurisdictions where the new employer or potential new employer are located.

Assignee of Rights and/or Obligations. The acquiring entities specified in the Notice include our assignees of rights and/or obligations, in the event of any reorganization, merger, amalgamation, business transfer, whether in whole or in part, sale, purchase, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock or similar transaction.

Data processors. As necessary for the Processing Purposes described above, personal data may be shared with one or more third parties, whether affiliated or unaffiliated, to process personal information under appropriate instructions ("Data Processors"). The Data Processors may carry out instructions related to workforce administration, IT system support, payroll and compensation, training, travel arrangement, compliance, and other activities, and will be subject to contractual obligations to implement appropriate technical and organisational security measures to safeguard the personal information, and to process the personal information only as instructed.

Other Third Parties. Other third parties include our custodian, beneficiaries, and industry associations.

International Transfers
As you may expect, some of the recipients we may share Employee Data and Sensitive Employee Data with may be located in countries outside where you are located (including, but not limited to Singapore, Hong Kong, India, United States, United Kingdom, Australia, Japan, Indonesia, the Netherlands, Africa) in order to carry out the purposes specified above. Where there is such a transfer, it will be done based on your consent or other legal bases in compliance with the applicable laws. To the extent we transfer your personal data to a country with a level of data protection standards not equivalent to your local data protection law, we will ensure that an adequate degree of protection is afforded to the transferred personal data, or the transfer is otherwise permitted in accordance with the applicable data protection law.
We will use appropriate safeguards and comply with the laws of the country to which your personal data is transferred. Details of the safeguards we use are available on request.
For Employees located EU and UK:
In some cases, we may share your data with recipients located in countries outside the European Union and / or European Economic Area ("EEA"). Some countries where recipients are located already provide an adequate level of protection for this data such as Switzerland, and transfers to other countries such as the USA may be protected under arrangements such as the EU-US Privacy Shield. Nonetheless, for transfers to Prudential Group entities outside the EEA, Prudential will be bound by the EU Standard Contractual Clauses pursuant to Article 46(2)(c) General Data Protection Regulation ), which the European Commission has assessed as providing an adequate level of protection for personal data, to ensure that your data is protected adequately.
If recipients are located in other countries without adequate protections for personal data, Prudential will take all necessary measures to ensure that transfers out of the EEA are adequately protected as required by applicable data protection law. This will include using appropriate safeguards such as the EU Standard Data Protection Clauses. You can ask for a copy of such appropriate safeguards by contacting us as set out below ("Who can I contact about this?").
Acting on someone else’s behalf?
If you give us personal information about another person (or persons) such as details of your family member, spouse, dependents, beneficiaries, witness, and other person referred by you, you represent and warrant that you have the authority to do so by:

informing such other person about this Notice;

obtaining consents where applicable or rely on other legal basis necessary to permit us to use such personal data in accordance to this Notice; and
-
undertaking to verify the accuracy and completeness of personal data provided by you and to update us of any change to the Personal Data provided.
How long will Prudential keep my personal information for?
It is our policy not to keep personal information for longer than is necessary. We may, for example, keep your personal information for a reasonable time after you have left to ensure that Prudential has the records it needs in the event of a dispute or regulatory investigation and to ensure that any ongoing obligations can be complied with and, such as complying with requests from regulators or to contact you about future work opportunities at Prudential. Where personal information is kept, that period will be determined based on the applicable local law. For further information regarding retention, please contact us as set out below.
Minor, Incompetent person, and quasi-incompetent person
As required by law in certain cases, we cannot collect, use, and/or disclose the personal data of minors, quasi-incompetent persons, and incompetent persons in absence of their parental or legal guardian consents. If you are minor, quasi-incompetent persons, or incompetent persons, please ensure that consent from your legal guardians are obtained when it is required. Where we learn that we have unintentionally collected personal data from minor without parental consent when it is required, or from quasi-incompetent persons and incompetent persons without their legal guardians, we will delete it immediately or process only if we can rely on other legal bases apart from consent.
What rights do I have in respect of my personal information?
Where applicable under local law, you have a number of rights in relation to your Employee Data and Sensitive Employee Data processed by us. There are exceptions and limitations to these rights, and the rights can be summarised in broad terms as follows:
(i) Right of access
You have the right to confirm with us whether your personal data is processed, and if it is, to request access to that personal data including the categories of personal data processed, the purpose of the processing and the recipients or categories of recipients, and request a copy of that personal data . We do have to take into account the interests of others though, so this is not an absolute right, and if you want to request more than one copy we may charge a fee.
Where applicable under local law, you may request the disclosure of the acquisition of the Personal Data obtained without your consent.
(ii) Right to rectification
You may have the right to rectify inaccurate or incomplete, and not to date personal data concerning you.
(iii) Right to erasure (right to be forgotten)
You have the right to delete your personal data if it is no longer needed for the purposes set out in the Notice or if there is no other legal basis for the processing.
(iv) Right to restriction of processing
In limited circumstances, you may have the right to request that we restrict processing of your personal data, however where we process Employee Data and Sensitive Employee Data for the Processing Purposes we think that we have a legitimate interest or other legal bases in processing that day which may override a request that you make.
(v) Right to data portability
You may have the right to receive personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you may have the right to transmit that data to another entity in certain circumstances.
(vi) Right to object and rights relating to automated decision-making
Under certain circumstances you may have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data, including direct marketing, profiling, by us and we can be required to no longer process your personal data. This may include requesting human intervention in relation to an automated decision so that you can express your view and to contest the decision.
(vii) Right to Lodge a complaint
You have the right to complain to a data protection authority or the competent authority where you believe our collection, use and disclosure of your personal data is unlawful or noncompliant with applicable data protection law where applicable. We would, however, appreciate the chance to deal with your concerns before you approach the authority, so please contact us in the first instance.
(viii) Right to Withdraw Consent
You have the right to withdraw your consents you have given for the processing of your personal data any time.
The withdrawal of consent will not affect the lawfulness of the collection, use and/or disclosure of your personal data and sensitive data based on your consent before it was withdrawn. If you do not provide (or withdraw) your consent which is necessary, we may not be able to enter into a contract with you or perform our contractual obligations.
Your request for exercising any of the above rights may be limited by the laws. There may be certain cases where we can reasonably and lawfully decline your request, for example, due to our legal obligation or court order.
If you do need to speak to us, the data controller of your personal data. We may monitor or record calls or any other communication we have with you. This might be for training, for security, or to help us check for quality.
Some of above rights are specific to candidates, staff and ex-staff residing within EU jurisdictions. The rights applicable to you will depend on data subject rights provided under your local privacy law.
